Terms of Service

1. Acceptance of Terms

By accessing, browsing, or utilizing the corporate delivery logistics portal, shipping APIs, fleet lease configurations, and customer sites of Diken Delivery UAE ("Services"), you acknowledge that you have read, understood, and agree to be bound by these Terms of Service ("Terms").

If you are entering into these Terms on behalf of a restaurant, e-commerce enterprise, or other corporate entity, you warrant that you possess the full legal authority to bind that entity to these conditions.

2. Scope of Services & Onboarding

Diken Delivery UAE provides commercial last-mile courier solutions, supply chain dispatching, fleet management, and dedicated rider leasing options.

To access partner portals and schedule dispatches, merchants must complete the onboarding registration form. You agree to provide accurate, current, and complete corporate registration details (including valid trade licenses) during onboarding. We reserve the absolute right to suspend or reject partnerships that fail compliance checks under UAE commercial regulations.

3. Delivery Protocols & SLAs

All deliveries scheduled through our platform are subjected to the following operational covenents:

  • Prohibited Items: Merchants must not dispatch any goods that are illegal under UAE Federal Laws, hazardous materials, flammable items, or valuable jewelry/currency. We reserve the right to inspect packages and decline delivery of suspicious cargo.
  • SLA Commitments: Our average last-mile delivery times (e.g., 30 minutes in commercial hot-spots) represent target windows. While our dispatch algorithm optimizes routes, SLAs do not apply in cases of extreme weather conditions, traffic accidents, force majeure events, or customs delays.
  • Zoning & Pricing: Fees are calculated based on flat zoning rates or dedicated lease parameters agreed upon in individual Service Level Agreements. Payments must be processed according to the invoice terms specified in the commercial dispatch contract.

4. Dedicated Rider Leasing Covenants

For merchants leasing dedicated riders:

  • Riders remain legally sponsored and employed by Diken Delivery UAE. Merchants may direct rider delivery runs during shift hours but must not request operations violating UAE traffic guidelines or labor laws.
  • Merchants must provide a safe environment for riders at pick-up points. Dedicated shifts must respect mandatory resting intervals in compliance with Ministry of Human Resources and Emiratisation (MOHRE) guidelines.

5. Liability Limitations

Except as explicitly set out in a signed Service Level Agreement, Diken Delivery UAE is not liable for indirect, incidental, or consequential damages resulting from delayed, damaged, or lost cargo.

For standard delivery orders, our absolute liability for proven physical damage or loss of goods in transit is strictly capped at either the cost value of the affected items or AED 500 per shipment, whichever is lower, unless extra coverage insurance has been declared and paid for prior to dispatch.

6. Intellectual Property

All website interfaces, code structures, logo designs, icons, copywriting, and software systems are the exclusive intellectual property of Diken Delivery UAE. Users must not reproduce, adapt, compile, or distribute our source resources without written corporate authorization.

7. Dispute Resolution & Governing Law

These Terms are governed by, and construed in accordance with, the Federal Laws of the United Arab Emirates and the local regulations of the Emirate of Dubai. Any disputes, controversies, or claims arising out of these Terms shall be subject to the exclusive jurisdiction of the Courts of the Emirate of Dubai, United Arab Emirates.
